Khula’/Talaaq for a Sum

- If the husband and wife cannot put up with each other and the husband refuses to give talaaq then it is permissible for the woman to give some money or her mehr and tell the husband, “Take this sum and let me go.”
- Or she can tell him: “For the outstanding mehr you owe me, let me go.”
- In response to the above if the husband says, “You can go,” then one talaaq-e-baain comes into effect.
- The husband then cannot stop her from going.
- If, however, the husband did not respond there; he got up and went away, or she went out of his presence and afterwards he said, “Okay you can go,” then this does not have any effect.
- The offer and acceptance should be in the same place.
- Releasing oneself from nikaah in this manner is called Khula’.
