Prepubescent Experiencing Bleeding with an Incomplete Tuhr
Reading Time: < 1 minute
- A prepubescent bleeds for a day, then remains clean for 2 days and then bleeds for another day.
- She is in haidh for all 4 days.
- Since the tuhr is incomplete, that is less than 15 days, this entire period is taken to be a stretch of bleeding.
- She thus bled, in effect, for 4 days.
- This case is represented as follows: 1B—2C—1B.
- Similar is the case if she bleeds for a day, followed by 3 days tuhr and then 2 days bleeding.
- All 6 days are haidh.
- Illustration: 1B—3C—2B.
- If she had 3 days of bleeding, 5 days tuhr and then one day bleeding, then too, according to Imaam Abu Haneefah and Imaam Abu Yusuf (Rahimahumallah), this entire period is of haidh. In other words, all 9 days are haidh.
- Illustration: 3B—5C—1C.
- According to Imaam Muhammad (Rahmatullahi alaih), only the first 3 days are haidh in this case.
- According to Imaam Muhammad, since the tuhr in-between (5 days in the example) is more than the combined bleeding before and after the tuhr (4 days in the example), the tuhr will separate the two periods of bleeding.
- For the sake of ease in understanding and application, the Muftis generally give the verdict in this case according to the view of Imaam Abu Haneefah and Imaam Abu Yusuf (Rahmatullahi alaihima).
