Khula’ Offer and Acceptance in the Same Place – Some Scenarios

  1. The husband said: “I hereby make khula’ with you.” In response the wife says: “I have accepted.” The khula’ is done.
  2. However, if the wife did not respond there and then, she got up, then there is no khula’.
  3. Similarly, if she rejected the offer, then there is no khula’.
  4. If, on the other hand, the wife did not respond immediately, but she remained in her place while the husband got up, then the wife accepts, the khula’ will be valid.
