If No Wasiyyat Was Made for Haj-e-Badal

  1. It is not permissible to take money from the estate of the deceased to perform Haj-e-Badal on his behalf if he/she did not make wasiyyat for it.
  2. Yes, if all the heirs, happily consent then it is permissible.
  3. Insha Allah, the Fardh Haj of the deceased will then be discharged.
  4. However, the permission granted by a minor heir is of no consideration.
  5. The minor’s share of the estate cannot be used for the Haj-e-Badal.
