Marital Rights Falling Away though Khula’

  1. The husband said: “I hereby make khula’ with you.” The wife accepted. No mention was made about money. All mutual rights are in this case waived.
  2. If mahr was outstanding, it too has become waived.
  3. If the woman had received her mahr, then it is not waajib upon her to return it.
  4. Nevertheless, she still is entitled to nafqah (expenses for food, clothing and shelter) till her iddat expires.
  5. Yes, if the woman said: “You don’t need to give me any expenses for the iddat”, then this too falls away.
