- A condition for the validity of the act of gifting is that the item should be handed over and possession should be taken thereof.
- If you told the next person, “I give you this item,” and he/she says, “I accept,” however, you did not give it to him physically, then the hibah (gifting) is not done.
- The item still belongs to you.
- When he/she takes possession of it, now he/she becomes the owner of it.
