A Condition for the Validity of Giving a Gift

  1. A condition for the validity of the act of gifting is that the item should be handed over and possession should be taken thereof.
  2. If you told the next person, “I give you this item,” and he/she says, “I accept,” however, you did not give it to him physically, then the hibah (gifting) is not done.
  3. The item still belongs to you.
  4. When he/she takes possession of it, now he/she becomes the owner of it.
