- If the man was at fault for the marital problems and subsequently khula’ was made, it is a major sin and haraam for him to take any money from the wife or make the khula’ in lieu of the unpaid mahr.
- Furthermore, if in this case he takes any money for the khula’, it is haraam for him to use it.
- If, however, the woman was at fault, then too the man should not take more than the mahr amount which he gave.
- He should make khula’ in exchange of the mahr paid.
- If he took in this second case more than the mahr amount, then however inappropriate, he is not sinful.
