Divorce Granted by a Non-Muslim Court

Q. A non-Muslim court of law granted divorce to a woman, but the husband has not yet pronounced Talaaq. The woman now wishes to marry another man. Is the divorce issued by a non-Muslim court recognized in Islam? Can the woman divorced so, marry another man?
A. The Shariah does not recognize the divorce granted by a non-Muslim court of law. The right of Talaaq is vested in the husband. Until such time that the husband did not pronounce Talaaq the woman remains his wife in terms of the Shariah. In the case concerned it is not lawful for her to marry another man.
