Qasam in the Name of Anything or Anyone Besides Allah Ta’ala

1. A Qasam (oath) is not valid in the name of anyone or anything besides in the Name of Allah.
2. Thus, taking an oath in the following ways does not constitute a Qasam:

• Qasam in the name of Rasulullah
• Qasam by the Ka’bah
• Qasam by my eyes
• Qasam by my hands and feet
• Qasam by my father
• Qasam by my children
• Qasam by my dear ones
• Qasam by your head
• Qasam by your life
• Qasam by my life
• Qasam in your name
• Qasam in my name

3. If one took an oath in the above manner and then violated the oath, there is no kaffaarah (atonement).
4. However, to take an oath in anything or in anyone else’s name besides in Allah Ta’ala, is a grave sin.
5. The Hadeeth Shareef has decried it.
6. To forsake the Name of Allah and take a qasam in anything or anyone else is an act of shir’k. One should exercise great caution in abstaining from this.
7. Here, what is meant by “an act of shir’k” is that it is a lessor category of shir’k. It is not the shir’k which will never be forgiven in the Hereafter.
8. Thus, if a person takes an oath in the name of something else besides Allah Ta’ala, he will not be said to have left the fold of Islam and His nikaah remains intact.
