Mother Losing Her Right of Custody by Marrying a Non-Mahram of Her Child

  1. If the mother married a person who is not the mahram relative of her child, she forfeits her right of custody.
  2. Mahram relative refers to someone with whom marriage is forever impermissible.
  3. However, if the mother marries a mahram of the child, then the right of the mother remains intact.
  4. Example of a mahram relative of the child is the child’s uncle (father’s brother).
  5. Besides the mother if any other female, such as the child’s sister or the child’s maternal aunt, is in custody of the child and she marries a non-mahram of the child, she too losses her right of custody.
